New York Public Divorce Records

Like any other vital records, certificates or decrees of divorce are legal documents. Such documents can be beneficial in various ways. You may need a legal copy of your divorce file should you wish to be remarried. It is always a brilliant idea to do a self background check to review the accuracy and completeness of the record. A record of divorce in New York can be obtained from the Vital Records Office in the Department of Health.

The central repository for divorce records in New York is the Vital Statistics Office which is operated by the State's Department of Health. Divorce files can be through decrees or certificates. Divorces that transpired before the year 1963 are in the form of decrees only. Divorce certificates are not public information. Hence, only those authorized by law are allowed to obtain a copy of such information. Those who can get a copy of a divorce record in the state are the persons indicated on the document and those that they authorize to claim the record.

Each copy of a divorce record in New York, either certificate or decree, is worth $15. Payment should be through check or money order made payable to the New York State Department of Health. Such fee is non-refundable regardless if the divorce record requested is found or not. In case the divorce record is not located, the office will issue a "Certificate of Failure to Find".

All record requests are subject to fee. For divorce record requests, a processing fee of $15 is requisite. This applies for the search and for the certified copy of a divorce certificate if the record is found. In case the record is not located, a "Certificate of Failure to Find" will be provided. The fee covers the record search itself, thus is will not be refunded. A check or a money order indicating the corresponding fee should be made payable to the New York State Department of Health.

Knowing when the divorce happened will hasten your endeavour in searching for the divorce record. With that, you will know what agency you should pay a visit to, either the Vital Records Division or the Circuit Clerk's Office. The necessary information that you also have to provide are the full names of the husband and the wife, the date and county where they had their matrimonial ceremony, the date and relevant county where the dissolution of marriage was granted. You also have to include in the request your personal details such as your name, address, and your phone number. You must also indicate your relationship to the couple and the reason for procuring such document.

Anyone who wishes to obtain divorce records can do so through mail or in person. The Vital Records Office will process personal requests. However, it may be inconvenient to travel to the office, stand in line to process such entreaty, and wait for days to weeks to get the results. Placing an order by mail will take several weeks to be processed. Mailing the record to the requestor will mean a further delay. Ordering the record online, on the contrary, is a much simpler and more practical way. Record search can be done anytime of the day and night hence, requests placed over the Internet will be processed very quickly and will be sent to you right away. What's more, you can even get divorce records free of charge from other sources in the web.
